WebAcappella Fusion Licence Terms

1. Definitions

• "Software": WebAcappella Fusion and its associated documents.
• "Use": the installation or running of the Software.
• "Back-up copy": a copy of the Software for strictly personal use.
• "Licence": the right to use the Software on the terms set out below.

2. The licence

You are purchasing a right of use, and not ownership of the Software.

A paid licence allows unlimited use in time, with no subscription.

Each licence is valid for two computers belonging to the licence holder.

A free version, unlimited in time, allows you to test compatibility before purchase.

3. Purchase, withdrawal and refund

The Software is digital content supplied on an intangible medium. In accordance with point 13° of article L. 221-28 of the Code de la consommation (French consumer code), the right of withdrawal provided for in article L. 221-18 may no longer be exercised once performance has begun following your prior express agreement and your express waiver of that right.

This waiver is requested from you when you place your order, before any download. Once given, the purchase is firm and final and gives rise to no refund.

The free version exists precisely so that you can try out the Software on your own equipment before buying it.

4. Restrictions on use

A licence is strictly personal: it may not be shared, lent or distributed.

Any modification, resale or reproduction of the Software or of its components (images, texts, scripts) is prohibited.

Installation on a shared network requires one licence per user.

No resale of a licence is possible without the written agreement of INTUISPHERE.

5. Transfer and intellectual property

You may transfer your licence to another computer, provided that you delete the previous installation.

The site templates supplied may only be used for websites created with the Software, and must not be resold.

The websites you create with the Software belong to you. You publish them with the host of your choice, and the publisher plays no part in their hosting or their distribution.

6. Liability and warranties

The Software comes with no warranty of continuous operation. It is your responsibility to back up your projects regularly.

INTUISPHERE is not liable for data loss or damage connected with the use of the Software.

The legal warranties of conformity and against hidden defects remain owed on the terms provided for by law.

7. Free version

The free version is unlimited in time and may be freely distributed, provided that it is neither modified nor sold.

8. Acceptance and termination

Installation of the Software constitutes acceptance of these terms.

You must provide accurate information about your identity when making your purchase.

Any breach of these terms results in the immediate cancellation of the licence.
